Efforts to Obtain Bail before trial

At the prosecutors’ insistence, the magistrate judge denied bail before the trial, in part on the grounds that a Jew should not be considered fully American, but rather a de facto dual citizen of Israel. This and other aspects of the bail denial were challenged by many individuals and organizations follows.

The National Director of the ADL, Abraham Foxman, sent a letter to the US Attorney General Michael Mukasey calling unconstitutional the claim that the Law of Return automatically made Jews dual citizens and heightened flight risks and urging him to instruct the US Attorneys in the case not to make that claim.
